1. Eligibility and Acceptance
You may use Mixtape Plug only if you can form a binding contract and your use is not prohibited by applicable law. You must provide accurate account, profile, payment, and submission information. You may not use the platform if you are barred from receiving services under the laws of the United States or any other applicable jurisdiction.
Mixtape Plug may offer both public browsing features and logged-in creator features. Access to some areas depends on account status, plan level, feature availability, or payment confirmation. Access to a feature at one point in time does not create a permanent right to that feature.
2. Accounts and Security
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials. Do not share passwords, bypass authentication, or permit others to use your account in a way that causes confusion about authorship, ownership, or responsibility.
If you use password-based login, you are responsible for maintaining a strong password. If you use Google sign-in, you are also responsible for the security of your Google account. Mixtape Plug may suspend or restrict access if Mixtape Plug reasonably believes an account is compromised, being used abusively, or creating legal or operational risk.
3. Plans, Billing, and Checkout
Mixtape Plug offers free and paid plans. Paid plan access may require completion of a Stripe Checkout flow or another designated payment flow. Pricing, included features, and promotional sale amounts may change prospectively. Published plan descriptions explain intended feature access but do not guarantee uninterrupted availability of every listed capability at all times.
If you purchase a paid plan through Stripe, your payment relationship may also be governed by Stripe’s terms and policies. Mixtape Plug does not store full payment-card details on its own servers through the current checkout flow. Mixtape Plug may store and rely on checkout session identifiers, plan metadata, payment status, subscription references, and similar records needed to confirm or reconcile account access.
Where a plan is sold on a recurring basis, it continues until cancelled in the applicable workflow unless the checkout terms or a signed agreement say otherwise. Stated prices generally do not include taxes, duties, bank fees, processor fees, or currency-conversion charges that a payment provider or applicable law may add.
A cancellation request made inside Mixtape Plug may affect Mixtape Plug’s local account state, but it does not necessarily guarantee that any independently created Stripe subscription has already been cancelled at the processor level unless Mixtape Plug expressly confirms that result. You remain responsible for reviewing your payment-processor records and billing statements. Except where required by law, fees are non-refundable once charged.
4. Credits and Usage-Based Features
Certain creator features operate on a credit model. Current cover-art pricing on the platform uses a per-action credit system, including separate costs for new generations, edits, and downloads. Credit allowances may vary by plan and may reset on a recurring cycle defined by Mixtape Plug.
- Credits are a limited feature entitlement, not money, stored value, property, or a refundable balance.
- Credits are non-transferable, may not be resold, and have no cash value.
- Mixtape Plug may change credit prices, credit allowances, or feature-access rules prospectively.
- Unless Mixtape Plug expressly says otherwise, credits reset according to the applicable cycle and do not roll over indefinitely.
- Mixtape Plug may deny an action when insufficient credits remain.
- Mixtape Plug may choose not to charge for clearly failed actions, but credits may still be consumed in other feature categories where the governing flow or provider rules say otherwise.
5. Creator Tools and AI Outputs
Mixtape Plug includes creator workflows that depend on third-party systems, including AI or generation providers. Outputs may be delayed, unavailable, incomplete, low quality, non-unique, or unsuitable for your intended use. Generated material can contain factual errors, rights issues, artifacts, formatting defects, or unexpected similarities to other works.
You are solely responsible for reviewing outputs before publication, distribution, commercial use, challenge submission, or public display. You must not rely on AI output as professional legal, financial, medical, or regulatory advice, and you must not use creator tools to generate unlawful, infringing, deceptive, harmful, exploitative, or policy-violating material.
Mixtape Plug may place limits on prompts, files, models, output sizes, session history, usage frequency, or workflow types. Mixtape Plug may also suspend or withdraw creator tools where provider access, infrastructure, moderation concerns, cost control, or legal risk requires it.
6. User Content and Licenses
“User Content” includes prompts, uploaded images, uploaded music, profile information, challenge submissions, support messages, artist-facing materials, and other content you provide through Mixtape Plug. You retain whatever ownership rights you have in your User Content, but you grant Mixtape Plug a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, format, transmit, display, and otherwise use that content as necessary to operate, maintain, improve, secure, and provide the service.
That license includes the right to pass content to service providers and generation providers where necessary to perform the requested feature, and to display content publicly where you intentionally submit it to public or semi-public experiences such as artist pages, challenge participation, leaderboard-related presentation, or profile discovery features.
You represent and warrant that you own or control the rights necessary to upload, submit, process, and use your User Content through Mixtape Plug, and that doing so does not violate law, contract, privacy rights, publicity rights, confidentiality obligations, or the intellectual-property rights of others.
If your content involves collaborators, producers, featured performers, samples, beat licenses, likeness rights, publishing interests, or royalty splits, you are responsible for obtaining the required permissions and maintaining accurate underlying agreements unless Mixtape Plug expressly assumes a narrower responsibility in a separate signed document.
7. Acceptable Use
You may not use Mixtape Plug to:
- Upload or submit content you do not have the right to use.
- Infringe copyrights, trademarks, publicity rights, privacy rights, or contractual rights.
- Submit unlawful, defamatory, threatening, harassing, fraudulent, deceptive, hateful, sexually exploitative, or otherwise abusive material.
- Probe, scan, reverse engineer, overload, scrape, or interfere with the platform, its APIs, hosting, or connected providers.
- Bypass usage limits, automate abusive requests, or manipulate credits, rankings, or feature access.
- Use the service to distribute malware, credential-harvesting schemes, spam, or other harmful code or campaigns.
- Impersonate another person or misrepresent your affiliation with an artist, company, label, or rights holder.
Mixtape Plug may investigate suspected misuse and may remove content, deny access, cancel sessions, refuse submissions, or preserve records for safety, compliance, or evidentiary purposes.
8. Challenges and Rankings
Challenge participation is optional and subject to posted challenge rules, file restrictions, eligibility conditions, and Mixtape Plug review. Challenge entries must be original, properly authorized, and accurate in title and artist naming. Mixtape Plug may reject, disqualify, down-rank, or remove any entry that violates rules, appears manipulated, or creates legal, operational, or reputational risk.
Mixtape Plug may determine winners, rankings, removals, and review outcomes in its reasonable discretion based on the challenge rules then in effect, including integrity review of plays, favorites, visits, follows, or other metrics. Rankings displayed during a challenge may be provisional and may change after audits, moderation, integrity review, or scoring adjustments.
9. Stage One Label Plans
Stage One plans are label-style plans and may create a record-label relationship rather than only a feature-access relationship. If you enroll in a Stage One plan and sign Mixtape Plug’s Record Label Agreement, the signed agreement governs the specific commercial and legal relationship.
Under the current Stage One framework described by Mixtape Plug, Stage One artists are signed for a 1-year, 2-year, or 3-year term depending on the selected plan and the executed agreement. During that term, music produced within the signing period may be treated as property of Mixtape Plug under the agreement, with Mixtape Plug assuming 50% ownership of song rights and taking the royalty percentage specified by the selected Stage One plan and contract. The signed Record Label Agreement controls the exact ownership, royalty, accounting, exclusivity, delivery, buyout, and remedy provisions.
Unless the signed agreement states otherwise, a Stage One artist may not negotiate or enter additional deals without Mixtape Plug during the signing term where the agreement restricts that conduct. An optional artist buyout may release the artist from some future deal obligations if Mixtape Plug allows it, but it does not automatically release music-rights ownership for the contract term if the agreement preserves those rights for the full term. If Mixtape Plug incurs monetary damages from a breach of the Record Label Agreement, Mixtape Plug may seek monetary damages and any other available contractual or legal remedies.
Public plan language such as “65% net royalties to the artist,” “70% net royalties,” or “85% net royalties” is high-level commercial shorthand. Unless a signed agreement expressly says otherwise, net royalty treatment may still depend on deductions, reserves, collection timing, recoupment, refunds, chargebacks, taxes, processor or distribution fees, split disputes, and other accounting treatment allowed by the governing agreement.
Stage One participation does not by itself make Mixtape Plug the artist’s employer, fiduciary, attorney, accountant, or personal manager. Unless the signed agreement expressly shifts a duty, the artist remains responsible for sample clearance, producer and writer splits, publishing and PRO registrations, collaborator permissions, and the underlying legality of the music delivered into the relationship.
Mixtape Plug may withhold or delay reporting, settlement, or payout where rights disputes, fraud signals, unpaid processor settlements, audit review, or unresolved booking or royalty issues require further review. Rights restrictions, accrued payment obligations, confidentiality, indemnity, and survival clauses in the signed agreement may continue after suspension, early release, or buyout if the contract says they survive.
10. Artist Bookings
Artist booking availability, rates, platform fees, hold policies, and payment handoff flows are subject to change and depend on artist participation and system configuration. A booking request is not final until Mixtape Plug or the relevant payment/confirmation workflow confirms it. Dates may become unavailable at any time before confirmation.
Mixtape Plug may charge a platform fee in connection with bookings. Mixtape Plug may also hold payout-related funds, review disputes, or delay settlement where fraud, chargeback risk, performance disputes, or contractual review requires it. Mixtape Plug is not the performer and does not independently guarantee the quality, legality, safety, or success of any artist performance or booking outcome.
Under the current Stage One framework, Mixtape Plug takes 15% of booking profits unless a different percentage is stated in a signed agreement or booking-specific commercial document. Booking-profit treatment may still be adjusted for refunds, taxes, chargebacks, processor fees, disputes, or other deductions where the governing agreement or booking flow allows that treatment.
Mixtape Plug may require reasonable identity, tax, banking, or payout-verification information before releasing booking-related funds where that information is needed for lawful settlement, fraud prevention, processor compliance, or payout administration.
11. Store and Product Pages
Mixtape Plug may display product pages, product catalogs, or merch previews. Unless and until a live checkout flow clearly states otherwise, product pages, cart buttons, or “Add To Cart” interactions may be informational, prototype, or preview functionality rather than a binding offer to sell. Product availability, pricing, images, descriptions, and options may change without notice.
Where Mixtape Plug enables artist merchandise sales, merchandise production and fulfillment may be handled by a third-party vendor or fulfillment partner. Mixtape Plug is not responsible for defective items, misprinted items, shipping damage, late delivery, lost packages, incorrect sizing, color variation, or other vendor-side fulfillment failures unless applicable law requires otherwise.
Mixtape Plug may apply a merchandise service fee and a platform share to merchandise profit. Under the current merch workflow, the service fee is $1.99 per merchandise sale, and Mixtape Plug’s platform share is 10% of merchandise sales profit after production cost and applicable fees. Product-sale proceeds may be held for 30 days before release for fraud review, refund review, dispute review, production reconciliation, and order-completion confirmation. Mixtape Plug may also test faster release structures, including an On-Deliver-Release pilot, for qualifying artists based on performance and account standing, but no artist is entitled to that pilot unless Mixtape Plug expressly grants it.
Merchandise profit treatment may also reflect the merchandise service fee, taxes, processor fees, refunds, discounts, chargebacks, reserve holds, vendor reconciliations, and other deductions or offsets allowed by the governing merch workflow. Mixtape Plug may require reasonable payout or tax information before releasing merchandise proceeds.
Additional merchandise economics, payout timing, and benefit-language definitions are described on the Plan Terms page. If Mixtape Plug later launches a live merchandise checkout flow, Mixtape Plug may publish additional seller, refund, payout, and vendor terms that will also apply.
12. Intellectual Property
Mixtape Plug and its platform design, branding, software, layout, text, graphics, interfaces, and service architecture are owned by Mixtape Plug or its licensors and are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are granted to you by implication, estoppel, or otherwise.
If you believe content on Mixtape Plug infringes your rights, send a detailed notice through Support or to info@mixtapeplug.com with sufficient detail for Mixtape Plug to evaluate the claim.
13. Third-Party Services
Mixtape Plug depends on third-party services for major parts of the platform, including hosting, email, authentication, payments, music workflows, and cover generation. Mixtape Plug is not responsible for downtime, policy changes, moderation decisions, billing errors, model behavior, or data handling practices that originate with those third-party systems, except to the extent required by law.
14. Suspension and Termination
Mixtape Plug may suspend, restrict, or terminate access to any account, session, creator workflow, submission, or feature at any time if Mixtape Plug reasonably believes there is a breach of these Terms, a rights issue, abuse, payment failure, fraud risk, legal exposure, or a security problem. You may stop using Mixtape Plug at any time, and you may close your account through available account settings where that feature is offered.
Suspension or termination does not automatically eliminate obligations that arose before suspension or termination, including payment obligations, indemnity duties, record-preservation needs, or legal claims that accrued beforehand.
15. Disclaimers
Mixtape Plug is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Mixtape Plug disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.
Mixtape Plug does not warrant that the service will be uninterrupted, error-free, secure, always available, or suitable for any specific commercial release, marketing campaign, challenge outcome, artist booking, or revenue objective.
16. Limitation of Liability
To the maximum extent permitted by law, Mixtape Plug and its owners, operators, affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, opportunities, bookings, reputation, content value, or business interruption arising out of or related to your use of the platform.
To the maximum extent permitted by law, the aggregate liability of Mixtape Plug for all claims arising out of or relating to the service will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid directly to Mixtape Plug for the specific paid service giving rise to the claim during the three-month period preceding the event giving rise to liability.
17. Indemnification
You agree to defend, indemnify, and hold harmless Mixtape Plug and its affiliates, operators, service providers, and personnel from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your User Content, your misuse of the service, your violation of these Terms, or your violation of any law or third-party right.
18. Governing Law and Disputes
Except to the extent prohibited by applicable law, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts.
Before filing a formal claim, you agree to first contact Mixtape Plug through Support and attempt to resolve the issue informally. Nothing in this section limits either party’s right to seek injunctive or equitable relief where necessary to prevent misuse, infringement, abuse, or unauthorized access.
19. Changes to These Terms
Mixtape Plug may update these Terms from time to time. Updated Terms become effective when posted, unless a later effective date is stated. Continued use of Mixtape Plug after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree to a change, stop using the platform.
